Situations When Tenant Can Say No To A Landlord

Most of us have lived in a rented property or still living in one but do we know the rights as a tenant? There are plenty of things which is considered when you live in a rented property.

The most important one is all verbal communication needs to get documented and should be signed by both the parties. There should be no hidden aspects and no misconduct or miscommunication. Here we have jotted down a few rights of tenant:

Verbal Agreement

If your landlord disagrees with a written agreement and emphasizes on an oral agreement for tenancy, then as a tenant you have the right to say NO. It’s very important to understand that now under tenancy law all the agreements must be in written and registered. As if your agreement is registered then only both the parties can avail the benefits mentioned under these laws.

Privacy in the rented property

The landlord cannot enter the premises without prior notice or communication with the tenant. The tenant has all the right to enjoy the privacy without any encumbrance from anyone including the owner.

Eviction notice

The landlord cannot evict the tenant in one night. A valid notice of one month or the time mentioned in the agreement, as well as the reason for eviction, should be shared by the landlord.

Security deposit

It is a law that the landlord cannot keep the security deposit and have to refund the same to the landlord after he/she vacates the premises.

Forced extension

The landlord cannot insist on the tenant to continue the tenancy. If the reason is valid and legally acceptable, then the tenant has all the right to vacate the premises.

Structural damage charges

The landlord cannot ask the tenant to pay the structural damage charges. Any sort of expenses related to structural damage has to be taken care of by the landlord.

So, these are a few points that every tenant should consider. These situations need attention and a proper way to handle. Therefore, it’s suggested to go through the points and prepare yourself for them beforehand.
